The Givonim demand seven of Saul's descendants, and David says אני אתן. He will give the Givonim whatever they ask for. But he protects one of Saul's descendants: {:he} >ויחמל המלך על מפיבשת בן יהונתן בן שאול; על שבעת ה׳ אשר בינתם בין דוד ובין יהונתן בן שאול׃ --שמואל ב כא:ז {:he} ><b>יב</b> ויאמר יהונתן אל דוד ה׳ אלקי ישראל כי אחקר את אבי כעת מחר השלשית והנה טוב אל דוד ולא אז אשלח אליך וגליתי את אזנך׃...<b>טו</b> ולא תכרית את חסדך מעם ביתי עד עולם; ולא בהכרת ה׳ את איבי דוד איש מעל פני האדמה׃ א ויכרת יהונתן עם בית דוד; ובקש ה׳ מיד איבי דוד׃ <b>יז</b> ויוסף יהונתן להשביע את דוד באהבתו אתו; כי אהבת נפשו אהבו׃ --שמואל א פרק כ (I would read כי אהבת נפשו אהבו not as "because of his love" but "despite his love"; Yonatan wanted an oath that David would never break and did not rely on their friendship alone). The contrast here is with Saul: David keeps his שבועה, where Saul breaks the שבועה that בני ישראל had made with the Givonim. But that oath was only with Yonatan and his descendants; the rest of Saul's family are not under David's protection. Our perek puts a very different spin on the story that is told in פרק ט: {:he} ><b>א</b> ויאמר דוד הכי יש עוד אשר נותר לבית שאול; ואעשה עמו חסד בעבור יהונתן׃ <b>ב</b> ולבית שאול עבד ושמו ציבא ויקראו לו אל דוד; ויאמר המלך אליו האתה ציבא ויאמר עבדך׃ <b>ג</b> ויאמר המלך האפס עוד איש לבית שאול ואעשה עמו חסד אלקים; ויאמר ציבא אל המלך עוד בן ליהונתן נכה רגלים׃ <b>ד</b> ויאמר לו המלך איפה הוא; ויאמר ציבא אל המלך הנה הוא בית מכיר בן עמיאל בלו דבר׃ <b>ה</b> וישלח המלך דוד; ויקחהו מבית מכיר בן עמיאל מלו דבר׃ <b>ו</b> ויבא מפיבשת בן יהונתן בן שאול אל דוד ויפל על פניו וישתחו; ויאמר דוד מפיבשת ויאמר הנה עבדך׃ <b>ז</b> ויאמר לו דוד אל תירא כי עשה אעשה עמך חסד בעבור יהונתן אביך והשבתי לך את כל שדה שאול אביך; ואתה תאכל לחם על שלחני תמיד׃ --שמואל ב פרק ט The gemara has a slightly different interpretation: {:he} >(שמואל ב כא:ח) וַיִּקַּח הַמֶּלֶךְ אֶת שְׁנֵי בְּנֵי רִצְפָּה בַת אַיָּה אֲשֶׁר יָלְדָה לְשָׁאוּל...וְאֶת חֲמֵשֶׁת בְּנֵי מִיכַל בַּת שָׁאוּל...מאי שנא הני? אמר רב הונא: העבירום לפני ארון, כל שארון קולטו—למיתה, כל שאין ארון קולטו—לחיים. המתיב רב חנא בר קטינא: וַיַּחְמֹל הַמֶּלֶךְ עַל מְפִיבֹשֶׁת בֶּן יְהוֹנָתָן בֶּן שָׁאוּל—שלא העבירו. וכי משוא פנים יש בדבר? אלא: שהעבירו וקלטו, ובקש עליו רחמים, ופלטו. ואכתי: משוא פנים יש בדבר? אלא, שבקש רחמים שלא יקלטנו הארון. --יבמות עט,א And the gemara leaves it at that. In the eyes of the gemara, David solves the trolley problem by putting in back in ה׳'s hands. Whoever the ארון indicates (presumably with the אורים ותומים again) will be given to the Givonim. That has happened before: {:he} ><b>טו</b> ויאמר אליהם משה; החייתם כל נקבה׃ <b>טז</b> הן הנה היו לבני ישראל בדבר בלעם למסר מעל בה׳ על דבר פעור; ותהי המגפה בעדת ה׳׃ <b>יז</b> ועתה הרגו כל זכר בטף; וכל אשה ידעת איש למשכב זכר הרגו׃ --במדבר פרק לא {:he} ><em>וכל אשה יודעת איש</em>:...אמנא ידעי? אמר רב הונא בר ביזנא אמר רבי שמעון חסידא: העבירום לפני הציץ. כל שפניה מוריקות—בידוע שהיא ראויה ליבעל, כל שאין פניה מוריקות—בידוע שאינה ראויה ליבעל. --יבמות ס,ב >There's a priest, a minister, and a rabbi. They're out playing golf, and they're trying to decide how much to give to charity. So the priest says, "We'll draw a circle on the ground, we'll throw the money way up in the air, and whatever lands inside the circle, we give to charity." The minster says no. "We'll draw a circle on the ground, throw the money way up in the air, and whatever lands outside of the circle, that's what we'll give to charity." The rabbi says "No, no, no. We'll throw the money way up in the air, and whatever G-d wants, he keeps!" --[_Short Circuit_](https://en.wikiquote.org/wiki/Short_Circuit_(1986_film)) But that doesn't work for charity, and it doesn't work here. {:he} >בדרך שאדם רוצה לילך בה, מוליכין אותו. --רש"י, במדבר כב:לה David is still morally culpable for what happens. The Torah is explicit: {:he} > לֹא יוּמְתוּ אָבוֹת עַל בָּנִים וּבָנִים לֹא יוּמְתוּ עַל אָבוֹת; אִישׁ בְּחֶטְאוֹ יוּמָתוּ׃ --דברים כד:טז {:he} >הנפש החטאת היא תמות; בן לא ישא  בעון האב ואב לא ישא בעון הבן צדקת הצדיק עליו תהיה ורשעת הרשע עליו תהיה׃ --יחזקאל יח:כ Only G-d's infinite knowledge allows G-d to "visit the sins of the fathers on the sons": {:he} >נצר חסד לאלפים נשא עון ופשע וחטאה; ונקה לא ינקה פקד  עון אבות על בנים ועל בני בנים על שלשים ועל רבעים׃ --שמות לד:ז What is David doing here? ---- {:he} > ויקח המלך את שני בני רצפה בת איה אשר ילדה לשאול את ארמני ואת מפבשת; ואת חמשת בני מיכל בת שאול אשר ילדה לעדריאל בן ברזלי המחלתי׃ --שמואל ב כא:ח We have to make a few minor points. First, Michal had no sons: {:he} >ולמיכל בת שאול לא היה לה ילד עד יום מותה׃ --שמואל ב ו:כג And she wasn't married to עדריאל בן ברזלי; her sister was: {:he} >ויהי בעת תת את מרב בת שאול לדוד; והיא נתנה לעדריאל המחלתי לאשה׃ --שמואל א יח:יט So the gemara says that Michal had adopted them: {:he} >אמר לך רבי יהושע: וכי מיכל ילדה? והלא מירב ילדה! מירב ילדה ומיכל גידלה, לפיכך נקראו על שמה. ללמדך שכל המגדל יתום בתוך ביתו מעלה עליו הכתוב כאילו ילדו. --סנהדרין יט,ב Second, רצפה בת איה wasn't Saul's wife; she was a concubine: {:he} >ולשאול פלגש ושמה רצפה בת איה; ויאמר אל אבנר מדוע באתה אל פילגש אבי׃ --שמואל ב ג:ז So none of these seven men were in line to inherit the throne from Saul. The only person who *was* in the line of succession was Yonatan's son Mephiboshet. The fact that David goes out of his way to save Mephiboshet proves that David isn't using this famine as an excuse to eliminate the competition. ---- But major point is the injustice: how could the Givonim demand revenge on the family of Saul, how could David have done this, and how could הקב״ה allow that to happen? Abarbanel gives the איוב answer: we can't understand ה׳'s reasons: {:he} >ואין לתמוה מאיחור העונש הזה כל כך מהשנים, כי משפטי ה' אמת צדקו יחדו ומחשבותיו עמקו, והוא היודע למה יענשו החוטאים בזמן זולת זמן ומי הוא ראוי מהבנים לקבל עונש האב. --אברבנאל, שמואל ב כא:א Levinas looks at it differently. He focuses initially on the Givonim themselves, and the fact that they are being asked to forgive Israel. {:he} > ויתנם ביד הגבענים ויקיעם בהר לפני ה׳ ויפלו שבעתים (שבעתם) יחד; והם (והמה) המתו בימי קציר בראשנים תחלת (בתחלת) קציר שערים׃ --שמואל ב כא:ט ה׳ didn't command the death of Saul's descendants. ה׳ commanded that the injustice done to the Givonim be remedied. *How* it is remedied is up to the human beings involved, especially the victims themselves. He starts with the gemara in Yoma, about the requirement to ask forgiveness when we offend another, and the requirement to forgive when asked. There is a story about Rav: {:he} >רב הוה פסיק סידרא קמיה דרבי. עייל אתא ר' חייא הדר לרישא. עייל בר קפרא הדר לרישא. אתא ר"ש ברבי הדר לרישא. אתא ר' חנינא בר' חמא, אמר כולי האי נהדר וניזיל? לא הדר. איקפיד ר' חנינא. אזל רב לגביה תליסר מעלי יומי דכפורי ולא איפייס... --יומא פז,א-ב >One can, if pressed to the limit, forgive the one who has spoken unconsciously. But it is very difficult to forgive Rab, who was fully aware and destined for a great fate, which was prophetically revealed to his master. One can forgive many Germans, but there are some Germans it is difficult to forgive. It is difficult to forgive Heidegger. If Hanina could not forgive the just and humane Rab because he was also the brilliant Rab, it is even less possible to forgive Heidegger. Here I am brought back to the present, to the new attempts to clear Heidegger, to take away his responsibility--unceasing attempts which, it must be admitted, are at the origin of this colloquium. > ...Since you still grant me a few minutes, I will compare this page, in which the issue was not murders but verbal offenses, to a more-tragic situation, in which forgiveness is obtained at a greater price, if it is still possible to obtain it. > [Levinas then summarizes our perek] > ...Do admire the savage greatness of this text, whose extreme tension my summary poorly conveys. Its theme is clear. It is about the necessity of talion, which the shedding of blood brings about whether one wants it or not. That is a capital crime, and cannot be appeased by money: {:he} ><b>ל</b> כל מכה נפש לפי עדים ירצח את הרצח; ועד אחד לא יענה בנפש למות׃ <b>לא</b> ולא תקחו כפר לנפש רצח אשר הוא רשע למות; כי מות יומת׃ <b>לב</b> ולא תקחו כפר לנוס אל עיר מקלטו לשוב לשבת בארץ עד מות הכהן׃ <b>לג</b> ולא תחניפו את הארץ אשר אתם בה כי הדם הוא יחניף את הארץ; ולארץ לא יכפר לדם אשר שפך בה כי אם בדם שפכו׃ <b>לד</b> ולא תטמא את הארץ אשר אתם ישבים בה אשר אני שכן בתוכה; כי אני ה׳ שכן בתוך בני ישראל׃ --במדבר פרק לה Now והגבענים לא מבני ישראל המה and they are not concerned with the halachic niceties of witnesses, and לֹא יוּמְתוּ אָבוֹת עַל בָּנִים. But Levinas points out that ה׳ still respects that "the right to forgive belongs only to the victim". And if we accept the interpretation of the בבלי, that מתוך שהרג נוב עיר הכהנים שהיו מספיקין להם מים ומזון, מעלה עליו הכתוב כאילו הרגן, then the Givonim were even more unreasonable, and unjust. But still, ה׳ demands that they be appeased. And appeasing them publicly declares: We, בני ישראל, were wrong in our injustice to the Givonim. We will pay any price to restore justice. And that is a קידוש ה׳. {:he} >והא כתיב (דברים כד:טז): לֹא יוּמְתוּ אָבוֹת עַל בָּנִים [וּבָנִים לֹא יוּמְתוּ עַל אָבוֹת; אִישׁ בְּחֶטְאוֹ יוּמָתוּ]? אמר רבי חייא בר אבא אמר רבי יוחנן: מוטב שתעקר אות אחת מן התורה, ואל יתחלל שם שמים בפרהסיא...והא כתיב (דברים כא:כג): לֹא תָלִין נִבְלָתוֹ עַל הָעֵץ! אמר רבי יוחנן משום רבי שמעון בן יהוצדק: מוטב שתעקר אות אחת מן התורה, ויתקדש שם שמים בפרהסיא. שהיו עוברים ושבים אומרים: מה טיבן של אלו? הללו בני מלכים הם. ומה עשו? פשטו ידיהם בגרים גרורים. אמרו: אין לך אומה שראויה להדבק בה כזו. ומה בני מלכים כך—בני הדיוטות על אחת כמה וכמה! ומה גרים גרורים כך—ישראל על אחת כמה וכמה! מיד נתוספו על ישראל מאה וחמשים אלף... --יבמות עט,א >...Last question: How were people able, in opposition to the strict prohibition of the Torah, to leave human corpses exposed for so many months and to profane the image of God they bear? Same answer: "It is better that a letter of the Torah be damaged than that the name of God be profaned!" The image of God is better honored in the right given to the stranger than in symbols. Universalism has a greater weight than the particularist letter of the text; or, to be more precise, it bursts the letter apart, for it lay, like an explosive, within the letter. We have here then a biblical text which the Midrash spiritualizes and interiorizes but which it preserves in its unusual power and harsh truth. David is not able to oppose a victim who cries out for justice, even if this justice is cruel.
