Why not simply frame him for stealing money? Or drum up some more ethereal charge, like seditious speech? And while we don't see it explicitly used in the Torah, the aggadah points out hints: {:he} > וישבו לפניו הבכר כבכרתו והצעיר כצערתו; ויתמהו האנשים איש אל רעהו׃ --בראשית מג:לג {:he} ><em>הבכור כבכרתו</em>: מכה בגביע וקורא ראובן, שמעון, לוי, יהודה, יששכר, וזבולן, בני אם אחת, הסבו כסדר הזה, שהיא סדר תולדותיכם, וכן כלם. כיון שהגיע לבנימין, אמר זה אין לו אם ואני אין לי אם, ישב אצלי. --רש"י, בראשית מג:לג {:he} >אֲנִי רוֹאֶה בַּגָּבִיעַ שֶׁשְּׁנַיִם מִכֶּם הֶחֱרִיבוּ כְּרַךְ גָּדוֹל שֶׁל שְׁכֶם, וְאַחַר כָּךְ מְכַרְתֶּם אֲחִיכֶם לְעַרְבִיִּים. --בראשית רבה צא:ו {:he} ><em>ויכרם ויתנכר אליהם וידבר אתם וגו'</em>, מלמד שנעשה להם כנכרי. נטל הגביע והקיש בו. אמר להם: אני רואה בגביע שלי כי מרגלים אתם. אמרו לו: כנים אנחנו...אמר להן...אני רואה בגביע ששנים מכם החריבו כרך גדול של שכם. אמרו לו: ומי הן? הקיש בגביע, אמר להן, שמעון ולוי שמם. --מדרש תנחומא, מקץ ח:ג The Tanchuma adds that the divination cup is נכרי, foreign, to the בני שראל way of thinking. And this is what Yosef frames them with. Why would they steal this goblet specifically? The Tanchuma suggests that Binyamin would have wanted to find his brother: {:he} ><em>ויאמר להם יוסף מה המעשה הזה אשר עשיתם</em>: אמר להם יוסף אני אומר לכם מפני מה גנבו הנער הזה לקסום בו ולידע היכן אחיו. --תנחומא בובר, מקץ יג:ח The בית הלוי suggests that the very fact that it was a magic cup made it valuable: {:he} >יש לפרש דהך ”הרעותם אשר עשיתם“ קאי על כל המעשים והויכוחים שעברו להם עד עתה עמו ובזו הגניבה קלקלו להם הכל. דהנה באמת על גניבת הגביע אין שום מקום לחושדם כלל דכמה היה שוה הגביע מול ערך שיווי הכסף של התבואה בעת הרעב שהחזירו לו ביושר לבם, וכמו שהשיבו לו (בראשית מד:ז-ח) וַיֹּאמְרוּ אֵלָיו לָמָּה יְדַבֵּר אֲדֹנִי כַּדְּבָרִים הָאֵלֶּה...הֵן כֶּסֶף אֲשֶׁר מָצָאנוּ בְּפִי אַמְתְּחֹתֵינוּ הֱשִׁיבֹנוּ אֵלֶיךָ...וְאֵיךְ נִגְנֹב מִבֵּית אֲדֹנֶיךָ כֶּסֶף אוֹ זָהָב, ואין שום מקום לומר שהם גנבוהו, וגם אם ימצא באמתחותם הגביע ע"כ אחר שמהו שם כדי להעליל עליהם. > ורק כיון דכל מה שאמר עליהם עד עתה ”מרגלים אתם“, ”לראות ערות הארץ באתם“; הרי אמר להם שיודע הכל ע"י הגביע שמגיד לו כל הנסתרות, וכן הוא להדיא בתנחומא שהקיש הגביע ואמר רואה אני שמרגלים אתם. וחֵפֵץ כזה שמגלה כל הנסתרות הרי הוא יקר המציאות ולא יסולא בזהב אופיר, ושוב אין הוכחה מהשבת הכסף שלא יגנבו חפץ יקר הערך כזה. > ...וזהו שאמר להם ”הרעותם אשר עשיתם“ דכל הפעולות והויכוחים שעשיתם עד עתה להוכיח מזה אשר כנים אתם קלקלתם בגניבה זו, דאתם בעצמיכם הראיתם להודיע לכל כי כל דברי הגביע הם אמת, דמי כהחכם היודע אם הגביע חפץ יקר או לא כמוכם. וזה היה חכמת יוסף להניח בשקם הגביע, דבזה נסתרו כל דברי ויכוחם והתנצלותם. --בית הלוי על התורה, מקץ I think the most logical reason why they would have stolen it is the reason suggested by the שפתי חכמים: {:he} ><em>הלא ידעתם כי נחש ינחש</em>: כלומר אעפ"י שגנבתם הכוס שאני מנחש בו ואם כן מהיכן יש לי לידע שאתם גנבתם אפ"ה מסברא היה לכם לידע זה כי איש כמוני וכו'... --שפתי חכמים, בראשית מד:טו This is implied by the בית הלוי as well. If they were spies, then they would steal the magic cup to stop Yosef from being able to track them down. It reminds us of the time Yosef's mother stole her father's magic statues: {:he} ><b>יט</b> ולבן הלך לגזז את צאנו; ותגנב רחל את התרפים אשר לאביה׃ <b>כ</b> ויגנב יעקב את לב לבן הארמי על בלי הגיד לו כי ברח הוא׃ --בראשית פרק לא Now, Rashi says she stole them to keep her father away from idol worship, but Rashbam notes that Lavan clearly believed in magic, and in divination: {:he} >ויאמר אליו לבן אם נא מצאתי חן בעיניך; נחשתי ויברכני ה׳ בגללך׃ --בראשית ל:כז So Rashbam proposes that Rachel also believed in the power of the magic statues, and that is why she stole them: {:he} ><em>ותגנוב רחל את התרפים</em>: שלא יגידו ויודיעו ללבן כי רוצה יעקב לברוח, כענין שנאמר (הושע ג:ד): וְאֵין אֵפוֹד וּתְרָפִים; (זכריה י:ב) כִּי הַתְּרָפִים דִּבְּרוּ אָוֶן. רגילים היו לקסום בהם. --רשב"ם, בראשית לא:יט Asher Wassertheil notes the connection to our story, and the fact that the brothers must have known about it: {:he} ><em>(בראשית מד:ט) אשר ימצא אתו מעבדיך ומת</em>: כבר שאלתי רבים, כיצד זה מדברים האחים כן, והרי בוודאי ידעו על מעשה רחל והתבטאותו של יעקב בסגנון דומה (בראשית לא:לב): עִם אֲשֶׁר תִּמְצָא אֶת אֱלֹהֶיךָ לֹא יִחְיֶה, ואמנם רחל מתה בדרך. --ברכת אשר, בראשית מד:ט Any way you understand it, the accusation only makes sense if the brothers think that the divination cup is real, that it has value and power. But they don't. That's a נכרי mindset. {:he} >והם השיבו לו כדבריהם ”הן כסף הנמצא כו' ואיך נגנוב כסף או זהב“. אמרו דאין שום מעלה כלל בהגביע ואינו רק חומר כסף או זהב. ואמרו כסף או זהב, דהא ודאי הרבה גביעים היה על השולחן מהם של כסף מהם של זהב כיד המלך ואמרו לו כאומר כי לא נתנו לב להחשיב הגביע והניחוש ואינם יודעים כלל מאיזו גביע הוא מדבר עמם אם של כסף או של זהב. --בית הלוי על התורה, מקץ {:he} >וראה גם ”העמק דבר“, לפיו אמר יעקב כן משום חשש, שמי שלקח את התרפים מבקש לעבוד אותם, ועל כן ”לא יחיה“. וממילא יש בזה משום תשובה לשאלתי, למה לא למדו בני יעקב מכאן להיזהר בלשונם, שכן אין הדברים דומים--כאן ע"ז ושם סתם גניבה. --ברכת אשר, בראשית לא:לב Atkins proposes that this is the point Yosef is trying to make to his brothers: you know, and I know, and I know you know, and you know I know, that there is no magic in the cup. {:he} >יוסף מתקן את דברי עבדו שבפסוקנו ואומר--לא בגביע אני מנחש כי אם מדעת ומסברה ובינה. --ברכת אשר, בראשית מד:ה >Joseph tells us explicitly that you can’t steal a divination cup from a diviner, because the diviner will know what you’ve done. But if this is the case, then what is the point of the cup to begin with? It’s just for show. Similarly, a magician doesn’t need the wand to do magic; rather, the wand is a kind of prop signifying, “Look, this is a magic show.” So there is an irony to stealing a diviner’s cup, a total misunderstanding of what divination is and where it comes from. Joseph is saying that you can’t take away his power. You can strip him of his props, but since his power is from a higher source, it won’t matter. > ...If every brother had a divination cup equal in size, this would not be an equality of outcome—for the meaning of the cup is not to be found in its composition. --Zohar Atkins, [_This is Not a Cup_](https://etzhasadeh.substack.com/p/this-is-not-a-cup) The brothers object that they know this--the symbol is not the thing, and taking away the symbol doesn't affect the underlying reality. Yosef says, "Aha! And what about a certain multi-colored coat, 22 years ago?" >But they didn’t take his cup! Exactly. There is nothing for them to steal. The value of the cup is worth far less to those who do not practice divination. To them, it is just an ordinary object. So why should the brothers have sought to diminish their brother by selling him into slavery seeing as there was no upside to their treachery? What do they gain by taking away Joseph’s coat of many colors, seeing as no power is conferred through the transfer? To take the cup, to take their brother, is like cutting off the arm to spite the hand. --Zohar Atkins, [_This is Not a Cup_](https://etzhasadeh.substack.com/p/this-is-not-a-cup) Yosef is reminding them, "You were jealous of a coat and a couple of dreams, and you thought that if you destroyed those--(בראשית לז:כ)‎ וְנִרְאֶה מַה יִּהְיו חֲלֹמֹתָיו--you would solve the problem. But they were just symbols of my potential as a human being. Kidnapping me was just as pointless as stealing by goblet would have been. If you want to deal with my potential greatness, you need to become greater yourselves." It's not so much that stealing the coat was like stealing the goblet, but that getting rid of *Yosef* was like getting rid of the goblet. They wouldn't solve their problem, wouldn't make Yaakov appreciate them more, by killing Yosef. {:he} >קנאת סופרים תרבה חכמה. --בבא בתרא כב,א And effectively that is what Yehudah does in the next parsha, becoming the leader who will pull the brothers back together into a nation.
