This week’s parsha deals with hanging, which is always a popular spectator sport.
The small boys came early to the hanging.
“It was a good hanging,“ said Syme reminiscently. ”I think it spoils it when they tie their feet together. I like to see them kicking. And above all, at the end, the tongue sticking right out, and blue a quite bright blue. That’s the detail that appeals to me.”
The Torah approach is different.
כב וכי יהיה באיש חטא משפט מות והומת; ותלית אתו על עץ׃ כג לא תלין נבלתו על העץ כי קבור תקברנו ביום ההוא כי קללת אלקים תלוי; ולא תטמא את אדמתך אשר ה׳ אלקיך נתן לך נחלה׃
תנו רבנן: אילו נאמר ”חטא ותלית“, הייתי אומר תולין אותו ואחר כך ממיתין אותו, כדרך שהמלכות עושה. תלמוד לומר: ”והומת ותלית“—ממיתין אותו ואחר כך תולין אותו.
חטא משפט מות: לפי הפשט מיירי בחטא דשייך למלוכה. ומנהג המלכים היה לתלות על עץ. ובא האזהרה שלֹא תָלִין וגו׳. וחז״ל אמרו שהוא מצוה כמו כן במגדף שיהיה נתלה על עץ. והרי גם זה מורד במלכות שמים.
[D]ans ce pays-ci il est bon de tuer de tems en tems un Amiral pour encourager les autres.
[I]n this country it is found good, from time to time, to kill one Admiral to encourage the others.
However much the government may want encourager les autres, the very act of displaying a body is a חילול השם. The halacha is that the hanging, if it is done, is for a moment, and leaves no memorial.
משהין אותו עד סמוך לשקיעת החמה, וגומרין את דינו, וממיתין אותו, ואחר כך תולין אותו. אחד קושר ואחד מתיר, כדי לקיים מצות תלייה.
אין תולין על אילן המחבר לקרקע אלא על התלוש כדי שלא יהא מחסר קציצה. שהעץ שנתלה עליו נקבר עמו שלא יהא לו זכרון רע ויאמרו זה העץ שנתלה עליו פלוני.
ורבותינו (סנהדרין מו,ב) דרשו כן בכל המלין את מתו שלא לכבודו, מה עץ שהוא נוול אף כל שהוא נוול. והנה לדעתם כִּי קִלְלַת אֱלֹקִים תָּלוּי, לומר אע״פ שזה ראוי לנולו לגדל חטאו לא תעשה כן.
And I would say that the very permission to hang the body is like the other מצוות that start the parsha, concessions to human nature.
ולקחת לך לאשה: לא דברה תורה אלא כנגד יצר הרע, שאם אין הקב״ה מתירה ישאנה באסור.
It is a חילול השם because every human being is created in the divine image.
כי קללת אלקים תלוי: זלזולו של מלך הוא, שאדם עשוי בדמות דיוקנו…משל לשני אחים תאומים שהיו דומים זה לזה, אחד נעשה מלך ואחד נתפס ללסטיות ונתלה, כל הרואה אותו אומר המלך תלוי.
שפך דם האדם באדם דמו ישפך; כי בצלם אלקים עשה את האדם׃
ולפענ״ד ביאור הענין הוא עפ״י דברי רש״י הנ״ל דהתליה הוא בזיון לצלם אלקים, דהרי כשמתבזה צלם אלקים זה גורם לשפיכות דמים וכמש״כ בפרשת נח…והיינו שהאזהרה לשפיכות דמים היא משום שהאדם עשוי בצלם אלקים, וא״כ כשמבזה את הצלם הרי הוא מרבה שפיכות דמים, ושפיכות דמים גורם לטומאת הארץ וכדכתיב לעיל בפרשת מסעי (במדבר לה:לג-לד): וְלָאָרֶץ לֹא יְכֻפַּר לַדָּם אֲשֶׁר שֻׁפַּךְ בָּהּ כִּי אִם בְּדַם שֹׁפְכוֹ׃ וְלֹא תְטַמֵּא אֶת הָאָרֶץ אֲשֶׁר אַתֶּם יֹשְׁבִים בָּהּ וגו׳.
The spectacle is bad for society, no matter how terrible the capital crime may have been.
I was present, myself, at the execution of Courvoisier…From the moment of my arrival…down to the time when I saw the body with its dangling head, being carried on a wooden bier into the gaol—I did not see one token in all the immense crowd; at the windows, in the streets, on the house-tops, anywhere; of any one emotion suitable to the occasion. No sorrow, no salutary terror, no abhorrence, no seriousness; nothing but ribaldry, debauchery, levity, drunkenness, and flaunting vice in fifty other shapes. I should have deemed it impossible that I could have ever felt any large assemblage of my fellow-creatures to be so odious.
When we talk about the צלם אלקים as the basis for ethical rules, we have to talk about Emmanuel Levinas.
The dimension of the divine opens forth from the human face.
In the 1950s and 1960s he gave a series of lectures on Talmud. One was about “Forgiveness” (a good topic for אלול!) and dealt with hanging in תנ״ך.
One can forgive many Germans, but there are some Germans it is difficult to forgive. It is difficult to forgive Heidegger…Here I am brought back to the present, to the new attempts to clear Heidegger, to take away his responsibility—unceasing attempts which, it must be admitted, are at the origin of this colloquium.
Where do we see hanging (and the importance of not displaying the body) in תנ״ך?
ג ויצמד ישראל לבעל פעור; ויחר אף ה׳ בישראל׃ ד ויאמר ה׳ אל משה קח את כל ראשי העם והוקע אותם לה׳ נגד השמש; וישב חרון אף ה׳ מישראל׃
כג ויעשו כן ויציאו אליו את חמשת המלכים האלה מן המערה; את מלך ירושלם את מלך חברון את מלך ירמות את מלך לכיש את מלך עגלון׃…כו ויכם יהושע אחרי כן וימיתם ויתלם על חמשה עצים; ויהיו תלוים על העצים עד הערב׃ כז ויהי לעת בוא השמש צוה יהושע וירידום מעל העצים וישלכם אל המערה אשר נחבאו שם; וישמו אבנים גדלות על פי המערה עד עצם היום הזה׃
ט ויקרא אבשלום לפני עבדי דוד; ואבשלום רכב על הפרד ויבא הפרד תחת שובך האלה הגדולה ויחזק ראשו באלה ויתן בין השמים ובין הארץ והפרד אשר תחתיו עבר׃…טו ויסבו עשרה נערים נשאי כלי יואב; ויכו את אבשלום וימתהו׃…יז ויקחו את אבשלום וישלכו אתו ביער אל הפחת הגדול ויצבו עליו גל אבנים גדול מאד; וכל ישראל נסו איש לאהלו׃
Those are all consistent. The body is taken down and buried. But there is one exception.
א ויהי רעב בימי דוד שלש שנים שנה אחרי שנה ויבקש דוד את פני ה׳;
ויאמר ה׳ אל שאול ואל בית הדמים על אשר המית את הגבענים׃ ב ויקרא המלך לגבענים ויאמר אליהם; והגבענים לא מבני ישראל המה כי אם מיתר האמרי ובני ישראל נשבעו להם ויבקש שאול להכתם בקנאתו לבני ישראל ויהודה׃ ג ויאמר דוד אל הגבענים מה אעשה לכם; ובמה אכפר וברכו את נחלת ה׳׃ ד ויאמרו לו הגבענים אין לנו כסף וזהב עם שאול ועם ביתו ואין לנו איש להמית בישראל; ויאמר מה אתם אמרים אעשה לכם׃ ה ויאמרו אל המלך האיש אשר כלנו ואשר דמה לנו; נשמדנו מהתיצב בכל גבל ישראל׃ ו יותן לנו שבעה אנשים מבניו והוקענום לה׳ בגבעת שאול בחיר ה׳;
ויאמר המלך אני אתן׃…ח ויקח המלך את שני בני רצפה בת איה אשר ילדה לשאול את ארמני ואת מפבשת; ואת חמשת בני מיכל בת שאול אשר ילדה לעדריאל בן ברזלי המחלתי׃ ט ויתנם ביד הגבענים ויקיעם בהר לפני ה׳ ויפלו שבעתם יחד; והמה המתו בימי קציר בראשנים בתחלת קציר שערים׃ י ותקח רצפה בת איה את השק ותטהו לה אל הצור מתחלת קציר עד נתך מים עליהם מן השמים; ולא נתנה עוף השמים לנוח עליהם יומם ואת חית השדה לילה׃
You could say that the sons of Shaul were hung by the Givonim, so it wasn’t a Torah violation.
ועל דעתי הענין בבני שאול המוקעים, מפני שלא היו תלויים בבית דין של ישראל ולא מיד ישראל כלל, אבל דוד נתנם לגבעונים לעשות בהם כרצונם, והם אשר הוקיעום ולא רצו לקברם
But the gemara doesn’t accept that. The gemara says that the קידוש השם of this act outweighed the חילול השם.
והא כתיב (דברים כא:כג): לֹא תָלִין נִבְלָתוֹ עַל הָעֵץ! אמר רבי יוחנן משום רבי שמעון בן יהוצדק: מוטב שתעקר אות אחת מן התורה, ויתקדש שם שמים בפרהסיא. שהיו עוברים ושבים אומרים: מה טיבן של אלו? הללו בני מלכים הם. ומה עשו? פשטו ידיהם בגרים גרורים. אמרו: אין לך אומה שראויה להדבק בה כזו. ומה בני מלכים כך—בני הדיוטות על אחת כמה וכמה! ומה גרים גרורים כך—ישראל על אחת כמה וכמה! מיד נתוספו על ישראל מאה וחמשים אלף…
Do admire the savage greatness of this text, whose extreme tension my summary poorly conveys. Its theme is clear. It is about the necessity of talion, which the shedding of blood brings about whether one wants it or not. And probably all the greatness of what is called the Old Testament consists in remaining sensitive to spilled blood, in being incapable of refusing this justice to whoever cries for vengeance, in feeling horror for the pardon granted by proxy when the right to forgive belongs only to the victim.

How were people able, in opposition to the strict prohibition of the Torah, to leave human corpses exposed for so many months and to profane the image of G-d they bear?…“It is better that a letter of the Torah be damaged than that the name of G-d be profaned!” The image of G-d is better honored in the right given to the stranger than in symbols…We have here then a biblical text which the Midrash spiritualizes and interiorizes but which it preserves in its unusual power and harsh truth. David is not able to oppose a victim who cries out for justice, even if this justice is cruel. To the one who demands ”a life for a life“, David answers, “I shall give”.
But the lesson of this perek is deeper. After the Givonim do this, David expels them from the community of Israel.
And yet the Gemara teaches more. A verse of the text (1 Samuel 21:2) indicates to us, seemingly as a simple piece of historical information: “The Gibeonites were not part of the children of Israel but of the rest of the Amoreans”. To this preliminary verse, the Gemara attaches the meaning of a verdict. It is David who would have excluded the Gibeonites from the community of Israel and relegated them to the Arameans. To belong to Israel, one must be humble (place something or someone higher than oneself ), one must know pity and be capable of disinterested acts. The Gibeonites excluded themselves from Israel…
It is no doubt this pity which the Gibeonites lacked! I have the impression that I have come back to the theme evoked by Mr. Jankélévitch when he opened this colloquium, even though no one in this hall has asked that the descendants of our torturers be nailed to the rocks. The Talmud teaches that one cannot force men who demand retaliatory justice to grant forgiveness. It teaches us that Israel does not deny this imprescriptible right to others. But it teaches us above all that if Israel recognizes this right, it does not ask it for itself and that to be Israel is to not claim it [emphasis mine].
לא תלין נבלתו. Allow yourself to forgive.
