<p>This week's parasha deals with יעקב's last words and his death. I'd like to look at what happens right after:</p> <blockquote lang=he><p><b>ב</b> ויצו יוסף את עבדיו את הרפאים לחנט את אביו; ויחנטו הרפאים את ישראל׃ <b>ג</b> וימלאו לו ארבעים יום כי כן ימלאו ימי החנטים; ויבכו אתו מצרים שבעים יום׃</p> <footer class=source>בראשית פרק נ</footer></blockquote> <p>We can insert lots of jokes here about how Jacob was the father of the nation of Israel, and now would be their mummy.</p> <blockquote lang=he><p>וענין החניטה שהיה נהוג למצרים ידוע מן המומייאן, שהם גופים הנחנטים שנתקיימו כמה אלפים שנה ולא שלט בהם הבלוי והרקבון.</p> <footer class=source>מלב״ם, בראשית נ:ב, ד״ה ויצו יוסף את עבדיו</footer></blockquote> <p>אברבנאל goes into more detail, based on <a href="http://www.perseus.tufts.edu/hopper/text?doc=Hdt.+2.86&fromdoc=Perseus%3Atext%3A1999.01.0126">Herodotus</a>:</p> <blockquote lang=he><p> ואמר ויצו יוסף את עבדיו הרופאים שהיו עבדיו לפי שהיה נוהג בטכסיסי המלכים עד שהיו לו רופאים במלאכת החנטה המיוחדת למלכים והם חנטו את ישראל והחנטה היא הוצאת המוח והלב והכבד וכן המעים והמרדות מתוך הגוף וימשחו הגוף מבית ומחוץ בשמן אפרסמון וימלא הקרבים מבית ומחוץ ממיני בשמים המיבשים לחלוחית הגוף...ובתוך ימים ישאר הגוף יבש וקשה על מתכונתו מבלי שנוי אבר מאבריו ונראה המת כאלו ישן ולא יתעפש ולא יסרח.</p> <footer class=source>אברבנאל, בראשית ממ:כט</footer></blockquote> <p>But why would יעקב be mummified? As מלב״ם asks:</p> <blockquote lang=he><p>אולם יפלא אם נהגו כן מצריים לפי אמונתם בעת ההיא, איך נהג בו יוסף בגוף הקדוש של אביו?</p> <footer class=source>מלב״ם, בראשית נ:ב, ד״ה ויצו יוסף את עבדיו</footer></blockquote> <p>First, what's wrong with mummies? There are two contradictory principles in Halacha about the dead. The first is that the body should be allowed to decay into the earth:</p> <blockquote lang=he><p>בזעת אפיך תאכל לחם עד שובך אל האדמה כי ממנה לקחת; כי עפר אתה ואל עפר תשוב׃</p> <footer class=source>בראשית ג:יט</footer></blockquote> <blockquote lang=he><p>וישב העפר על הארץ כשהיה; והרוח תשוב אל האלקים אשר נתנה׃</p> <footer class=source>קוהלת יב:ו</footer></blockquote> <p>The second is that the corpse be given a modicum of dignity and not be placed on display:</p> <blockquote lang=he><p><b>כב</b> וכי יהיה באיש חטא משפט מות והומת; ותלית אתו על עץ׃ <b>כג</b> לא תלין נבלתו על העץ כי קבור תקברנו ביום ההוא כי קללת אלהים תלוי; ולא תטמא את אדמתך אשר ה׳ אלהיך נתן לך נחלה׃</p> <footer class=source>דברים פרק כא</footer></blockquote> <blockquote><p>The guiding religious ideal in regard to embalming is that a person upon his demise should be laid to rest naturally. There should be no mutilation of his body, no tampering with his remains, and no handling of the body other than for the religious purification. Disturbance of the inner organs, sometimes required during the embalming procedure, is strictly prohibited as a desecration of the image of G-d</p> <p>...</p> <p>There are, however, several exceptions to the general prohibition of embalming. These are:</p> <ul> <li>When a lengthy delay in the funeral service becomes mandatory.</li> <li>When the burial is to take place overseas.</li> <li>When governmental authority demands it.</li> </ul> <p>...Rabbinical authority must be consulted to determine the permissibility of embalming and the method to be used.</p> <footer class=source><a href="http://www.amazon.com/gp/product/0824604229/ref=as_li_ss_tl?ie=UTF8&camp=1789&creative=390957&creativeASIN=0824604229&linkCode=as2&tag=bililitecom-20">Rabbi Maurice Lamm (2012) <cite>The Jewish Way in Death and Mourning</cite>, pp. 14-15</a></footer></blockquote> <p>The commentators have a number of different ways of addressing this question. One approach is that חניטה is not mummification; it is just the application of spices and perfumes:</p> <blockquote lang=he><p>...וּפְקַד יוֹסֵף יַת עַבְדוֹי יַת אַסְוָותָא לְבַסְמָא יַת אָבוֹי</p> <footer class=source>תרגום יהונתן, בראשית נ:ב</footer></blockquote> <blockquote lang=he><p>ענין מרקחת בשמים הוא</p> <footer class=source>רש״י, שם, ד״ה לחנט את אביו</footer></blockquote> <p>But a process that requires רפאים would seem to be more anatomically involved. Another possible explanation is that בני ישראל were not subject to this law before the Torah was given. While I couldn't find anyone who says that explicitly here, it seems to be implied in the אברבנאל and רמב״ן:</p> <blockquote lang=he><p>...ויש לשאול אם כן איך הקים יעקב מצבה (בראשית כח:יח) ונשא שתי אחיות...ועמרם נשא דודתו (שמות ו כ)...והנראה אלי מדעת רבותינו שלמד אברהם אבינו התורה כלה ברוח הקדש ועסק בה ובטעמי מצותיה וסודותיה ושמר אותה כולה כמי שאינו מצווה ועושה ושמירתו אותה היה בארץ בלבד ויעקב בחוצה לארץ נשא האחיות וכן עמרם כי המצות משפט אלקי הארץ הן</p> <footer class=source>רמב״ן, בראשית כו:ה, ד״ה וישמור משמרתי</footer></blockquote> <p>מלבי״ם gives a Kabbalistic answer that explains the connection of the גוף and the רוח that requires the body to decay, and that it didn't apply to יעקב who was a צדיק. We will not deal with that in detail, but that idea (that יעקב was somehow not subject to the prohibition of embalming) is the basis for the אור החיים's explanation:</p> <blockquote lang=he><p>עשה כן יוסף משום כבוד אביו כי כן משפט הנכבדים ומכל שכן גדולי המלכות</p> <p> או כדי שלא יטעו בו כשלא יחנטוהו שלא מת או שמת ולא הסריח ויעשוהו אלוה כי הוא פלא בעמים המזוהמים וסובב לבלתי יעלהו לארץ קבורתו, ואם לא היה טעמים הנזכרים הדבר פשוט כי בלא חניטה לא היה מסריח...</p> <footer class=source>אור החיים, בראשית נ:ב, ד״ה ויחנטו הרופאים</footer></blockquote> <p>Where does the idea that יעקב didn't actually die come from?</p> <blockquote lang=he><p>רב נחמן ור׳ יצחק הוו יתבי בסעודתא א״ל רב נחמן לר׳ יצחק לימא מר מילתא א״ל הכי א״ר יוחנן אין מסיחין בסעודה שמא יקדים קנה לושט ויבא לידי סכנה בתר דסעוד א״ל הכי א״ר יוחנן יעקב אבינו לא מת א״ל וכי בכדי ספדו ספדנייא וחנטו חנטייא וקברו קברייא א״ל מקרא אני דורש שנאמר (ירמיהו ל:י) ואתה אל תירא עבדי יעקב נאם ה׳ ואל תחת ישראל כי הנני מושיעך מרחוק ואת זרעך מארץ שבים מקיש הוא לזרעו מה זרעו בחיים אף הוא בחיים.</p> <footer class=source>תענית ה,ב</footer></blockquote> <blockquote lang=he><p>ויכל יעקב לצות את בניו ויאסף רגליו אל המטה; ויגוע ויאסף אל עמיו׃</p> <footer class=source>בראשית מט:לג</footer></blockquote> <p>Almost all commentators explain this metaphorically:</p> <blockquote lang=he><p>הצדיקים אף במיתתן קרוים חיים</p> <footer class=source>רש״י, בראשית יא:לב, ד״ה וימת תרח בחרן</footer></blockquote> <blockquote lang=he><p>תני ר״ש בן יוחאי אומר כל מי שיש לו בן יגע בתורה כאילו לא מת</p> <footer class=source>בראשית רבה, וירא, מט:ד </footer></blockquote> <p>But this would not explain the אור החיים, or explain why it is יעקב specifically who is called לא מת.‎ אברבנאל brings up these problems:</p> <blockquote lang=he><p>האמנם רבי יוחנן אמר (תענית דף ה,ב) יעקב לא מת... וכבר חשבו אנשים שהיה כוונת ר׳ יוחנן שיעקב לא מת מיתת הנפש כי היא צרורה בצרור החיים. ואינו מחוור כי זה לא נתיחד ביעקב כי גם על הצדיקים במיתתם נקראים חיים ולא נצטרך לדרוש המקרא עליו אבל תוכן זה הענין הוא שכאשר שמע השומע מאמר רבי יוחנן ”יעקב אבינו לא מת“ חשב שהיה דעתו שלא נתפרדה החבילה מגופו וע״כ הקשה אם כן מאי הוא אשר ספדו ספדיא וחנטו חנטיא. והמקשה ההוא לא הבין כוונת רבי יוחנן כי הנה השלם ר׳ יחונן ראה שבאברהם ויצחק וכן במשה ובאהרן ובשאר הנביאים והקדושים אמר הכתוב <em>וימת</em> אלא ביעקב שכאשר ספר הכתוב פטירתו אמר בו <em>ויגוע</em> <em>ויאסף</em> ולא אמר <em>וימת</em> והשב השלם שהיתה הסבה בזה לפי שהאומה בכללה עם היות שנקראה זרע אברהם ויצחק לא נקראה האומה עצמה בשם אברהם ולא בשם יצחק ולא בשם משה אבל נקראה האומה בשם יעקב וישראל. ומזה הצד והבחינה צדק השלם באמרו ”יעקב לא מת“ כי עדין לא מת והיא האומה בכללה וכאשר המקשה הקשה עליו מבלי הבנת כוונתו השיב רבי יוחנן לענין הדרוש לא לדברי המקשה כי בידוע היה שחנטו גופו וספדו על הפרד נפשו ממנו אבל אמר מקרא אני דורש ”ואתה אל תירא עבדי יעקב ואל תחת ישראל“...מורה שהבטיחו ששם יעקב וכן שם ישראל יהיו חיים וקיימים לעד כמו שהוא חי וקיים...</p> <footer class=source>אברבנאל, בראשית ממ:כט</footer></blockquote> <blockquote><p>The unasked question here is that this verse seems to be speaking directly to Yaakov/Yisrael as an individual ("הִנְנִי מוֹשִׁיעֲךָ" in the singular; "וְאֶת זַרְעֲךָ" - "your descendants") instead of to the <em>nation</em> as a people. Now, that this verse is addressed to Yaakov even though he is, of course, dead is not a problem. Yirmiyahu has poetic license. But how is he promising that Yaakov <em>himself</em> will be "saved", when we know that it is actually the nation of Israel that will be saved?</p> <p>The answer is that Yaakov will be saved in that his name will continue to live in the sense mentioned above and not die out by his descendants being assimilated or annihilated. Thus, Yaakov/Yisrael is saved <em>in that</em> his nation will be saved. He continues to "live" <em>in that</em> his nation continues to live. And this is what R' Yochanan (or R' Yitzchak) means by "מקיש הוא לזרעו מה זרעו בחיים אף הוא בחיים". So long as his nation lives and continues to be called by his name, he lives on.</p> <p>This idea we learn from the above verse in Yirmiyahu, and that is why the verse in Bereshis omits the phrase "וימת יעקב". This is what R' Yochanan is saying he meant when he said "יעקב אבינו לא מת".</p> <footer class=source><a href="http://judaism.stackexchange.com/a/13172">judaism.stackexchange.com user jake</a></footer></blockquote> <p>So we have a non-mystical interpretation; Jacob does not die in that he lives on in the nation he started. Even when they are not "ישראל" (as we said <a href="/%D7%A4%D7%A8%D7%A9%D7%AA+%D7%95%D7%99%D7%92%D7%A9+%D7%AA%D7%A9%D7%A2%D7%B4%D7%93">last week</a>, the name that indicates the complete nation) but only "יעקב" (as we are when we are in galut), we embody the legacy of יעקב and thus we can say יעקב אבינו לא מת.</p> <p>The אור החיים was a Kabbalist and I suspect he meant his comment of שלא מת או שמת ולא הסריח literally, as a statement about יעקב's body not decaying and thus יוסף faced the danger that he would be made into an Egyptian god. But I would put a different spin on it: when we say יעקב אבינו לא מת we are talking about <em>our</em> embodying his values and his legacy. The Egyptian approach would have been to make him a god himself, so that burying him in Egypt (even with the intent of disinterring him and re-burying him in כנען) runs a terrible risk. יוסף felt he had to allow the Egyptians their 30 days of mourning, so יעקב's body had to be preserved (as we said above). But the embalming process (while technically allowing the body to last to be buried in כנען) has problems:</p> <p>The Netziv brings the Midrash to show that, in fact, יוסף was wrong to embalm his father:</p> <blockquote lang=he><p><em>ויצו יוסף את עבדיו</em> למה מת יוסף לפני אחיו רבי ורבנן רבי אמר על שחנט את אביו אמר ליה הקדוש ברוך הוא לא הייתי יכול לשמור את צדיקי לא כך אמרתי לו (ישעיה מא) את תיראי תולעת יעקב אל תראי תולעת את יעקב ורבנן אמרי הוא שצוה אותן שיחנטו אותו הה״ד ויעשו בניו לו.</p> <footer class=source>בראשית רבה, ויחי, ק:ג</footer></blockquote> <blockquote lang=he><p>כאן נרמז התרעומות שהגידו חז״ל; דמש״ה כתיב כאן <em>ישראל</em> ולא <em>יעקב</em> אלא רמז להפליא כי חניטו רופאי אוה״ע את ישראל שהיו מצוין במעלה וקדושה שנקרא שמו ישראל.</p> <footer class=source>העמק דבר, בראשית נ:ב, ד״ה ויחנטו הרפאים</footer></blockquote> <blockquote lang=he><p>אכן יש להבין דעתו של יוסף...נמשכו הבכי ואבל משך רב. ומש״ה חשש יוסף שלא יתקלקל ח״ו בשכבו על המטה, ולא כמו אברהם ויצחק שהיגיעו לקבורה מיד...אבל הקב״ה הקפיד על זה שבודאי היה הצדיק נשמר בכל אופן גם על המטה.</p> <footer class=source>הרחב דבר, שם</footer></blockquote> <p>So the embalming process, even if technically halachicly permissible, was another sign of how deeply בני ישראל were being assimilated into Egyptian culture.</p>
