This week's parsha includes the commandment to select a king: {:he} ><b>יד</b> כי תבא אל הארץ אשר ה׳ אלקיך נתן לך וירשתה וישבתה בה; ואמרת אשימה עלי מלך ככל הגוים אשר סביבתי׃ <b>טו</b> שום תשים עליך מלך אשר יבחר ה׳ אלקיך בו; מקרב אחיך תשים עליך מלך לא תוכל לתת עליך איש נכרי אשר לא אחיך הוא׃ --דברים פרק יז I am not going to go into the question of whether a מלך {:la}/per se/ is mandatory or not; I will assume that at least a ממלכה, a government, is mandatory. {:he} >רבי חנינא סגן הכהנים אומר: הוי מתפלל בשלומה של מלכות, שאלמלא מוראה, איש את רעהו חיים בלעו. --משנה אבות ג:ב Much of this comes from רב אביעד תבורי's [_דין מורד במלכות_](https://www.etzion.org.il/he/halakha/studies-halakha/din-mored-bemalkhut). I'm going to look at the powers of a מלך (again, reading this as "government"). Shmuel warned the people about the dangers of an absolute dictator: {:he} ><b>יא</b> ויאמר זה יהיה משפט המלך אשר ימלך עליכם; את בניכם יקח ושם לו במרכבתו ובפרשיו ורצו לפני מרכבתו׃ <b>יב</b> ולשום לו שרי אלפים ושרי חמשים; ולחרש חרישו ולקצר קצירו ולעשות כלי מלחמתו וכלי רכבו׃ <b>יג</b> ואת בנותיכם יקח לרקחות ולטבחות ולאפות׃ <b>יד</b> ואת שדותיכם ואת כרמיכם וזיתיכם הטובים יקח; ונתן לעבדיו׃ <b>טו</b> וזרעיכם וכרמיכם יעשר; ונתן לסריסיו ולעבדיו׃ <b>טז</b> ואת עבדיכם ואת שפחותיכם ואת בחוריכם הטובים ואת חמוריכם יקח; ועשה למלאכתו׃ <b>יז</b> צאנכם יעשר; ואתם תהיו לו לעבדים׃ <b>יח</b> וזעקתם ביום ההוא מלפני מלככם אשר בחרתם לכם; ולא יענה ה׳ אתכם ביום ההוא׃ <b>יט</b> וימאנו העם לשמע בקול שמואל; ויאמרו לא כי אם מלך יהיה עלינו׃ <b>כ</b> והיינו גם אנחנו ככל הגוים; ושפטנו מלכנו ויצא לפנינו ונלחם את מלחמתנו׃ --שמואל א פרק ח But there is one power not listed: capital punishment. {:he} >וכן הוא אומר (שמואל ב כ:כב): וַתָּבוֹא הָאִשָּׁה אֶל כׇּל הָעָם בְּחׇכְמָתָהּ [וַיִּכְרְתוּ אֶת רֹאשׁ שֶׁבַע בֶּן בִּכְרִי וַיַּשְׁלִכוּ אֶל יוֹאָב]...ר' שמעון אומר, כך אמרה להם: כל המורד במלכות בית דוד חייב מיתה. --תוספתא תרומות (ליברמן) ז:כ {:he} >כל המורד במלך ישראל יש למלך רשות להרגו. אפלו גזר על אחד משאר העם שילך למקום פלוני ולא הלך או שלא יצא מביתו ויצא חיב מיתה. ואם רצה להרגו יהרג. שנאמר (יהושע א:יח) כׇּל אִישׁ אֲשֶׁר יַמְרֶה אֶת פִּיךָ וְלֹא יִשְׁמַע אֶת דְּבָרֶיךָ לְכֹל אֲשֶׁר תְּצַוֶּנּוּ יוּמָת רַק חֲזַק וֶאֱמָץ. --משנה תורה, הלכות מלכים ג:ח מורד במלכות is a capital crime. Where does that power come from? Rambam cites a pasuk from יהושע, one that is not only not from the Torah, but that isn't a commandment at all: it's a statement by the people *about* the leader. The מהר"ץ חיות dealt with this question in his תורת נביאים. >As a traditionalist [Rabbi Zvi Hirsch Chajes (1805-1856)] unequivocally upheld the Sinaitic origin of both Written Law and Oral Tradition; he defended the irrevocability of Talmudic legislation against the inroads of the evolutionary approach which viewed Talmudic law as but one link in a long chain, with no subsequent binding force. Yet, his emphasis on historical perspective--in itself a mark of the modern period--often caused him to echo an undertone of the very historic evolutionary approach which he condemned. [ו]שיהיה רשאי לענוש ולענות נפש ומכל שכן להמית מנא ליה? ורק בני ישראל אמרו ליהושע כׇּל אִישׁ אֲשֶׁר יַמְרֶה אֶת פִּיךָ...יוּמָת רַק חֲזַק וֶאֱמָץ...הקושיא אין הנביא רשאי לחדש, זהו קושיא שצע"ג. --שו"ת חתם סופר, חלק אורח חיים סימן ר"ח Chajes's answer is that אין הכי נמי, it's *not* from the Torah. בני ישראל told Yehoshua that they would abide by his rule, and so they and the society they founded are subject to that rule. This is called the "social contract theory" of government. >In moral and political philosophy, the social contract is an idea, theory, or model that usually, although not always, concerns the legitimacy of the authority of the state over the individual. The founders rejected any "divine right of kings" or any other basis for the authority of the government; it was only by the consent of the governed. >We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America. --Preamble to the Constitution of the United States But there is a halachic problem. >And for the support of this Declaration, with a firm reliance on the protection of divine Providence, we mutually pledge to each other our Lives, our Fortunes and our sacred Honor. --US Declaration of Independence In our hypothetical social contract, we can pledge our Fortunes ((ערוך השולחן, חושן משפט סו:ל)‎ כל תנאי שבממון קיים), and we can be מוחל on our Honor, but we don't own our Lives. Threatening the government threatens lives. He connects the law of מורד במלכות to an earlier halacha: {:he} > <b>ט</b> ובאת אל הכהנים הלוים ואל השפט אשר יהיה בימים ההם; ודרשת והגידו לך את דבר המשפט׃ <b>י</b> ועשית על פי הדבר אשר יגידו לך מן המקום ההוא אשר יבחר ה׳; ושמרת לעשות ככל אשר יורוך׃ <b>יא</b> על פי התורה אשר יורוך ועל המשפט אשר יאמרו לך תעשה; לא תסור מן הדבר אשר יגידו לך ימין ושמאל׃ <b>יב</b> והאיש אשר יעשה בזדון לבלתי שמע אל הכהן העמד לשרת שם את ה׳ אלקיך או אל השפט ומת האיש ההוא ובערת הרע מישראל׃ <b>יג</b> וכל העם ישמעו ויראו; ולא יזידון עוד׃ --דברים פרק יז Ibn Ezra says that the שופט of this pasuk is the king; being the court of final authority is one of the major duties of the king: {:he} ><em>ואל השופט</em>: הוא המלך שכתב משנה התורה מיד הכהנים. --אבן עזרא, דברים יז:ט {:he} >והיינו גם אנחנו ככל הגוים; *ושפטנו מלכנו* ויצא לפנינו ונלחם את מלחמתנו׃ --שמואל א ח:כ As the preamble says, the government's job is to "insure domestic Tranquility" (we will not go into the laws of נלחם את מלחמתנו, the other role of Government, "provide for the common defence"). {:he} >ולפי מה שפירש הראב"ע ששופט דהכא היינו מלך א"כ יהיה לנו מקור מן התורה לדין המורד במלכות חייב מיתה, והיינו...מורד במלכות חייב מיתה בידי שמים אלא שרשות ביד המלך להרגו. --אמת ליעקב, דברים יז:ט Since establishing a ממלכה is a religious obligation, betraying that ממלכה is a rebellion against ה׳. Such a person is חייב מיתה בידי שמים:‎ ומת האיש ההוא. Once that is accepted, the government has the authority to make that מיתה happen. {:he} >כל ההורג נפשות שלא בראיה ברורה או בלא התראה אפילו בעד אחד או שונא שהרג בשגגה יש למלך רשות להרגו ולתקן העולם כפי מה שהשעה צריכה והורג רבים ביום אחד ותולה ומניחן תלויים ימים רבים להטיל אימה ולשבר יד רשעי העולם. --משנה תורה, הלכות מלכים ג:י {:he} >והנה המתבונן בלשונו של הרמב"ם...שכתב בזה"ל: כל המורד במלך ישראל יש למלך רשות להרגו כו' חייב מיתה ואם רצה להרגו יהרג...יראה דיש להעיר מה זה שהאריך וכתב ”חייב מיתה ואם רצה להרגו יהרג“, ומוכח מזה כמש"כ לעיל דבאמת יש על המורד חיוב מיתה בידי שמים, ולפיכך התירה התורה את דמו ואם רצה המלך להרגו יהרוג. --אמת ליעקב, דברים יז:ט {:he} >המורד במלכות הוא עבריין, ובית הדין רשאי ואף חייב לדונו למיתה. הרמב"ם מחדש שהמלך רשאי להורג את המורד במלכות בעצמו, שלא דרך בית הדין, באופן דומה לזה שהרמב"ם מציג בהלכה הבאה, העוסקת ברוצח... --רב אביעד תבורי, [_דין מורד במלכות_](https://www.etzion.org.il/he/halakha/studies-halakha/din-mored-bemalkhut) The מורד במלכות is not guilty of <i lang=fr>lèse-majesté</i>; that's not something that warrants חייב מיתה. He is guilty of undermining the very basis of the society that the Torah envisions: והאיש אשר יעשה בזדון לבלתי שמע אל הכהן..או אל השפט leads to איש את רעהו חיים בלעו, a life nasty, brutish and short.
